On September 2nd, the U.S. Department of State announced that the annual quota for the EB-2 (employment second preference) immigrant visa category is fully allocated for the Fiscal Year 2025. New numbers will become available on October 1, 2025, which is the beginning of the next government fiscal year.
What does this mean? With EB-2 immigrant visa numbers unavailable, anyone who would have been able to file an application to adjust status or process for an immigrant visa at a U.S. consulate in the EB-2 category can no longer do so. They must wait until October 1 numbers are published. Their priority date will need to be current in the October visa bulletin.
File Form I-140 if based upon PERM. Applicants who were eligible to file the I-140 immigrant visa petition and an application to adjust status in September must file the Form I-140 before the PERM expires. Then when the priority date is current again, applicants can file their applications to adjust status.
What will happen on October 1? The October visa bulletin, which should be published in the middle of September, will reset the numbers for October 2025. These may or may not be the same as the September dates prior to becoming unavailable; the numbers can also progress forward or retrogress.
